Terms of Service

These Terms of Service ("Terms") govern your access to and use of Gigflow, operated by Gigflow Operator("we", "us", or "our"). By creating an account or using the Service, you agree to these Terms.

1. The Service

Gigflow provides software for gig economy vendors to create booking forms, public business pages, manage enquiries, and related tools. We may update, modify, or discontinue features at any time.

2. Accounts

You must provide accurate information when registering and keep your credentials secure. You are responsible for all activity under your account. You must be at least 18 years old to use the Service.

3. Subscriptions and billing

Paid plans (Pro, Business) and add-ons (such as AI token packs) are billed on a recurring or one-time basis as described at checkout. Payments are processed by Dodo Payments as our merchant of record for subscription billing.

• Subscriptions renew automatically each billing period unless cancelled before the renewal date.
• You can cancel anytime from your account billing settings or the customer portal provided by our payment processor.
• Price changes will be communicated in advance where required by law.

Refunds are governed by our Refund Policy.

4. Acceptable use

You agree not to:

• Use the Service for unlawful, fraudulent, or harmful purposes
• Upload malware, spam, or content that infringes others' rights
• Attempt to gain unauthorized access to our systems or other accounts
• Resell or sublicense the Service without permission
• Misrepresent your identity or business to clients or to us

We may suspend or terminate accounts that violate these Terms or pose risk to the platform or other users.

5. Your content

You retain ownership of content you upload (forms, images, business information, client enquiry data). You grant us a limited license to host, display, and process your content solely to provide the Service.

You are responsible for ensuring you have rights to any content you publish and for complying with applicable laws when collecting client information through your forms.

6. Client data

When clients submit your booking forms, you act as the data controller for that client information. We process it on your behalf as a service provider. See our Privacy Policy for details on how we handle data.

7. Free plan limits

Free accounts are subject to usage limits (such as monthly enquiry caps) as described on our pricing page. Exceeding limits may require upgrading to a paid plan to continue receiving new enquiries.

8. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE OPERATION.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GIGFLOW OPERATOR AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM.

10. Termination

You may close your account at any time by contacting us. We may terminate or suspend access for violation of these Terms. Upon termination, your right to use the Service ends. Provisions that by nature should survive (limitation of liability, governing law) will survive.

11. Changes to Terms

We may update these Terms from time to time. Continued use after changes constitutes acceptance. Material changes will be communicated via email or in-app notice where appropriate.

12. Governing law

These Terms are governed by the laws applicable in the jurisdiction where Gigflow Operator operates, without regard to conflict-of-law principles. Disputes shall be resolved in the courts of that jurisdiction, unless otherwise required by mandatory consumer protection laws.
